Nick brings a wealth of law firm and corporate experience to Bailey & Glasser. He spent his first four years in the practice of law as a commercial and business litigation attorney and the next six years distinguishing himself as a trusted in-house attorney for the country’s biggest publicly-traded mining and energy companies.
Nick litigates commercial and environmental disputes all over the country. His recent litigation matters include a dispute over complex financial derivative products governed by an ISDA Master Agreement in the Lehman Brothers bankruptcy case in New York; a bet-the-company litigation involving allegations of breach of a complex sale-leaseback transaction and of veil piercing of multiple layers of a Master Limited Partnership in Illinois; a dispute over interpretation of the recoupment provision in a $320,000,000 royalty agreement in Illinois; a $100,000,000 dispute over failure to develop mineral properties in West Virginia; a request to enjoin his client’s business operations arising out of a dispute over the National Environmental Policy Act (NEPA) in Tennessee; the defense of hundreds of product liability cases over the safety of personal protective equipment in Kentucky; the prosecution of injunction actions against competitors in a trade secret and non-solicitation dispute in Missouri; and the prosecution of a federal court action over the misuse and misapplication of federal grant money and former federal property in Utah.
He also solves complex environmental and reclamation compliance and permitting issues for energy clients, having recently negotiated favorable groundwater restoration agreements with the State of Illinois and worked on intricate mixing zone applications for discharge of surface waters.
